EULA - End User License Agreement

INFOTOUCH SOFTWARE LICENSE AGREEMENT

Before installation the User shall read carefully the license Agreement and accept all terms and conditions of this Agreement. Lack of acceptance by the User of any term of the Agreement precludes the possibility of installation, using, distribution or other use of the InfoTouch Software in whole or in any of its parts.

1. COPYRIGHT
All copyrights to the InfoTouch Software are entitled GAGASOFT LTD. Software to which this license is protected by copyright law and international treaties. Violation of these rights is subject to criminal and civil liability.

2. GRANT OF LICENSE TO USE
This Licence Agreement has been entered into by GAGASOFT LTD and the User who has bought, installed and made use in any way of the software labeled as the InfoTouch Software. The User hereby acknowledges and accepts that GAGASOFT LTD will monitor the usage of the InfoTouch Software and can periodically verify license validity for the InfoTouch Software.

3. RESTRICTIONS ON USE
The User has got right to use only one copy of the InfoTouch Software on a single computer and has got right to make only one back up copy. The back up copy shall provide information regarding copyright. The back up copy shall not be used on any additional computers.

The User do not has right to:
disassembly, decompile and regenerate source code
make any modifications of the Software
create own software extending functionality of the InfoTouch Software
make use of the InfoTouch Software as a part of other software
make use of the InfoTouch Software and its any part in any publications without written consent of the producer and without providing information on the producer.

If the InfoTouch Software you have obtained is marked as a “TRIAL” or as a 'DEMO' you may install one copy of the Software for testing purposes for a definite period. Upon expiration of the period you can buy a licence or the Software must be uninstalled and all copies destroyed.

Attention: you can use a demo version only for non-commercial purposes.

4. SOFTWARE MAINTENANCE AND UPDATES
All updates and email support are free of costs for a period of one year following the purchase of the InfoTouch Software.
In order to receive program updates and free email support after the first year it is necessary to pay a renewable annul maintenance fee. By paying the annual maintenance fee the license holder is entitled to receive all program updates and free email support for another year.

5. GUARANTEE AND WARRANTEE
The InfoTouch Software is provided 'AS IS' without warranty of any kind, expressed or implied, including but not limited to the warranties of fitness for a particular purpose.
GAGASOFT LTD does not bear responsibility for any damages arising from use of the InfoTouch Software including loose of data, benefits, income and profits.
GAGASOFT LTD does not bear responsibility for any damages that the Software may cause to the User or the third party as a result of program operation or its failure.
GAGASOFT LTD does not grant any warranty and guarantee for the InfoTouch Software in respect of perfect operation in all possible combinations and applications as well as its quality and meeting of the User expectations.

6.AGREEMENT TERMINATION
This Agreement has been concluded for an indefinite period.
The Agreement shall be terminated if infringement of the above defined terms by the User follows.

7.ADDITIONAL LICENSES
The application InfoTouch uses the library AForge.NET (http://www.aforgenet.com/framework) under the LGPL v3 (http://www.gnu.org/licenses/lgpl.html)
